But Dr Ink sez that "apparently you can function quite normally during the blackout, you just forget all about it later". Did wikipedia tell you that?

Laffranchi was actually quite sober earlier on in the night. He WAS drinking though, because i have photos of him and myself that night with beers in our hands. He had cut his hand on a broken glass and went off to hospital to get stitches before meeting the rest of the team back in Kings Cross. But [furrycat] with the remarks you have made it is quite obvious you don't have a clue on what you are talking about in this instance, because if you did you wouldn't be posting what you are.

You clearly dont know what a blackout is furry...its NOT passing out.

I remember one arvo went up to the local RSL, met some mates there, played snooker for a few hours , some keno later, spent about 7 hours there. I thought that was it for ther night, ran into one mate the next day, apparently at about 11 the night before we left the RSL and went to the pub till about 2, I was dropped home in a cab....I apparently was as normal at the pub as a drunk at 2am on a Sun morning can be, but I will never remember it. I wasnt asleep, wasnt passed out.
That is a blackout.

Yeh, that happens I guess, but what does that have to do with the girl in this case, why she caught cabs, made 21 phone calls, was out dancing.

You have made a rather large assumption several times throughout this thread that if a man and woman get drunk and have sex, then the man has raped the woman.

You have even stated that being drunk does not excuse the actions of a man, but it does excuse the actions of a woman.

It seems to me that you are completely incapable of taking an unbiassed opinion on this case. I sincerely hope that you are excused from sitting on any jury involving a rape case.

bullsh*t again... thats not always the case and you're making facts up.

You remember that ad on TV about drink driving where the guys heads are see through and you can see their brain? Well the basic outline of that add says that you can drive while under the unfluence but if something goes wrong, you are almost powerless to stop it. Basic functions like making phone calls and driving can be done while under the influence, but the choice to do them is impared.

According to the law, if a bar tender serves alchahol to someone who is already drunk, they can be fined up to $5500. The same fine applies to a bar tender that lets someone who is drunk, drive. Now, IMO, if someone is drunk to the point that they cannot remember it, how can they have the choice to drive or have sex.

Several times, and ive never taken drugs (besides alcohol) in my life.



The latest incident where i cant remember several hours of the night or significant events happend on the night of riverfire here in brisbane in september last year. After a bottle of bundy at my mates place i went to meet my boss for his bucks night at some seedy strip joint in the vally.



All I remember from that night is hailing a cab outside my mates place, being at the strip club, thats it. I dont remember the cab ride, how long i was there, when i left or how i got home (back to my mates place).

I only found out a few days later at work after speaking to my boss that id been hit by a car BEFORE going into the club, apparently id gotten out of the cab, walked in front of it as it was driving away and been run over by it. He only knew this because i told him when i saw him inside. I still dont know how i got home but i remember waking up the next day with a swollen and bruised wrist but no idea how i got it.

My point is that blacking out and forgetting every detail of the night is very possible and can happen without the use of drugs.

Thanks Charlie, I really never new that, its never happend to me. Iv hurt myself and not felt pain but the next day I sure did.

That's not to say that she was not drugged, or otherwise. But whatever the crux of her argument is, she definitely has a legal leg to stand on. Laffranchi could be in some very serious trouble.

Has this actually been enacted? I haven't seen any evidence of that fact other than these articles urging the upper house to block it. What was the end result? I can't believe the laws have been introduced in that fashion. It is a total abuse of natural justice.

At this point the burden of proof beyond all reasonable doubt lays with the prosecution.

I can't see how they can possibly make the weight of evidence required, given the alleged victim has admitted to drinking heavily and can't remember what happened. This is regardless of any issues of consent. She can't remember what happened and can't level a charge. I can't see how a reasonable jury can convict someone based on a guessing game. Therefore it should be dismissed. Perhaps more evidence will come to light .

Drink spiking is heinous and is usually evident when the person has only had one drink and then experiences severe intoxication. If there is heavy drinking involved it is almost impossible to prove.

I actually didn't mean to suggest she was pursuing this for a pay out. I think some prosecutor is trying to make a name for himself. This really is a very weak case prima facie.

I dont know the details of this case, but I would imagine that the police would have physcial evidence before seeking a prosecution.

Not in any way commenting on this particular case, but someone charged under these circumstances could find themselves in a heap of crap.

Prosecution will try to prove:

1. The woman was too drunk to offer informed consent
2. Intercourse took place

Really, that's all they have to do.

No they would have to prove that his assumption of consent was unreasonable. There would be a standard of the ordinary reasonable person, however the level of his intoxication would have to be taken into account. If an ordinary person was intoxicated to his point would they assume that consent was given would be the test.
