Maybe, maybe not.

It will now depend on the degree of negligence, based on what a normal person* would do under the same circumstances. Also depends on what is normal in SA society, who all seem to have guns under their pillows.

* Having said that Oscar is not a normal person. His reaction to an intruder would be different to mine. He jumps out of bed on his stumps and would feel far more inadequate and vulnerable than I.

PS. I reckon he did it with intent. Had a roid rage moment and shot his missus - 4 times. Realized he f**ked up and thought quick on his feet. His remorse was genuine cos he knew that it meant life in the slammer. The state did a poor job nailing him beyond reasonable doubt. This is why I said yesterday that I didn't give a f**k. Expect the state to appeal this.

Re Oscar case

A truckie who was off his head and crossed over to the wrong side of the hwy and killed 3 or 4 was sentenced to 17 years today.

I'll leave you to ponder if him taking meth and driving was as culpable as Oscar arming himself and shooting at an erroneous intruder (which is what the court will asses regardless of what you think really happened).
