ASADA asks witnesses to sign affidavits; move to shore up evidence a sign investigation is moving forward

ASADA has asked witnesses interviewed as part of the Essendon investigation to sign affidavits regarding evidence given in the early days of the probe.

The Herald Sun understands the witnesses — at least two who are believed not to be players — were approached in the past week.

The move from the anti-doping agency to shore up its evidence is a sign the 15-month investigation, which has frustrated the AFL and Essendon over the time it has taken to proceed, is moving forward.

The Herald Sun last week reported Bombers players would receive show-cause notices asking them to explain why they should not be served with infraction notices over the alleged use of peptide thymosin beta 4.

Essendon players are yet to receive any correspondence from ASADA and club chairman Paul Little vented his frustration at the lack of communication on Friday night.

“What then should be the message that I pass on to our players, our players families, members and supporters, sponsors and staff?” Little said.

“Fifteen months on our players are still carrying the heavy burden of continued speculation in the media with no concrete timetable for the ASADA process to conclude.”

AFL chief executive Gillon McLachlan said he hoped a decision about whether Bombers players would be issued show cause notices or not would be made in “the back end of May”.

New ASADA boss Ben McDevitt said he would bring a sense of urgency to closing the case, but warned that he would not sacrifice certainty for speed.

Former Essendon sports scientist Stephen Dank remains the only person involved in the 2012 Essendon supplements program to have been sent a show cause notice, but the Anti-Doping Rule Violation Panel — which is independent of ASADA — is yet to decide if his details should be put on the Register of Findings.

Dank has denied giving Essendon players any banned substance, and said he would take legal action immediately if the Register of Findings decision is taken.

Former NRL star Sandoor Earl said on Sunday he had told his lawyer to prepare an appeal of his ban to the Administrative Appeals Tribunal — although that can’t be lodged until he is entered onto the register.

In August last year, Earl admitted the 2011 use of banned peptide CJC-1295 and was provisionally banned by the league.

He did not get a show-cause letter from ASADA until March this year.

News Corp reported Earl’s legal team would argue his admission to ASADA was coerced and his decision to accept provisional suspension two days later came under duress.

Mad you should know being the historian you are that, Paul Hayward went to Thailand with the sole purpose of making a quick buck and getting in and out as quick as possible.

We all know that didn't work out to plan.

Sandor on the other hand has been run out of the game with no real legal reason. He is still standing around unable to do anything.

Considering it has taken 9 months to get virtually no-where with him after his admission, he should be allowed to play footy.

He has a finite career length & he'll be ready for retirement when ASADA finally charge him. Won't matter if he gets a 4 year ban then.

hasnt earl admitted using illegal substances? isnt that a reason enough for him to be banned unofficially or otherwise? asada are geniused and should have finalsied whatever sanctions they were doing with him months ago, but he's still admitted using illegal substances -he doesnt get to whinge about being hard done by

It's the circumstances which he used them that deserves leniency (because of mis-information provided to him about what he was taking for his shoulders rehab) on his possible maximum 2 year sentence, IMO.

The maximum 2 year ban on the charge of trafficking because he took them from Dank to the Dr for injection is laughable & should be tossed out. Talk about a scapegoat charge!

I think if he's been out of the game for 9 months, he's served a fair suspension already.

Simply by what the new boss said.

So if you get a "show Cause" notice you are in big shit.

who told Earl to go to Dank?

probably asada given how incompetent they seem. but regardless of whoever told him to see dank, he's still meant to be responsible for what he takes (not saying its an easy black and white scenario).

I have no sympathy for earl. asada should have finalsied his penalty months ago but he still did the wrong thing

I'm surprised the club didn't have a recommended dr/rehab program they would have expected him to visit but then it sounds like they were a skint shambles at the time. No one comes out of it looking good just sandor paid the heaviest price.

If his club told him to see Dank I would think him getting a 2year ban pretty bloody harsh.

According to this and numerous other sources, the club didn't know about it and he did this behind there backs.

So essentially as per the previous article people are basically asking for Sandor Earl to be judged at a lower level than a 16 year old gymnast.

I'm surprised the club didn't have a recommended dr/rehab program they would have expected him to visit but then it sounds like they were a skint shambles at the time. No one comes out of it looking good just sandor paid the heaviest price.

Reading the above article, the club did have a recommended rehab physio, that they thought he was seeing exclusively.

Because this is dragging on I think people are starting to blame everybody, but honestly in this instance it looks like its all on Earl.

The whole thing was just political and has run its course , just forget shit that happened 3 years ago and move on , the players will be retired by the time they finnish this embarrassing investigation .

Should that be the same approach to the Bulldogs or Storm salary cap rorts?

If, and that's a big IF, players are issued with notice's its because its believed they took banned substances, that's an issue, politics or not.

A bit of an update from the AFL side of things, as the developments probably will have knock on effects at the Sharks.

Yesterday, Essendon called a meeting of players and parents to, as Damien Barrett put it, "prepare for the worst".

So it looks like there's no bullshit this time. ASADA will be moving very soon and the long, drawn out legal battles begin.
