i disagree and even if there were harsher penalties i can't see how it would prevent it from happening

it wasn't intentional just an accident

It doesn't have to be intentional to be negligence. Any footballer worth his salt knows lifting tackles can end in serious injury. There's no way MacLean meant to hurt McKinnon. But there's absolutely no doubt the tackle was completely negligent

Being injured in a routine activity on the sporting field is different to being injured by illegal and unsafe play. It's not a terrible analogy because this is a workplace for these guys, and MacLean was completely negligent in making the tackle the way he did. It doesn't mean he's "at fault" so to speak, but he does bear some responsibility for what happened.

If he wins this opens a whole new can of worms for the NRL. There are ALOT of ex league players out there suffering from injuries as a direct result of playing the game.

While I feel sorry for Alex, you knew the risks.

I know the risks of going on the roads but if a drunk driver hits me and leaves me paralysed I am suing that merkin for as much as I can take.

Horse shit.

So if you get injured by someone else anywhere in life, you'll let it slide because you knew the risks? Get decked on a night out...too bad, sometimes there are fights at pubs, you knew the risks.

And given we have seen heaps since it is obvious that in the speed of the tackle these things happen without the player meaning to do it, easy to say don't lift but clearly it's not that easy to avoid or we wouldn't continue to see it so regularly.

Ive always wondered why they didnt make lifting over the horizontal an automatic 10 in the bin?

This seemed to stop players throwing punches pretty quickly

Make it a potential send off and actually enforce it. f**king go all out. There is absolutely no reason to ever lift a player over the horizontal. Granted, it's usually an accident but so what? There is no reason to put your hand between a blokes legs and lift him. None. It's an incredibly dangerous way to tackle and no one's really doing anything to rub it out.

but you can't sue the Government for making the road or sue the cops/courts for letting a dunk drive and not having harsh enough penalties for doing so

I think that would be a deliberate act wouldnt you?

Yep and then i'd go and sue the government over it. Not.

A more fitting analogy would be if you were driving and someone in another car sneezed and crashed into you would they be negligent?

Answer is no, WA has just put a levy on car tax to cover no fault cases like the above.

that doesn't prevent illegal plays from happening

Crack down on it and actually send merkins off and it'll work....of course, if refs are too gutless to march blokes then it's pointless but no coach is going to sit by and let his players continue to tackle in a manner than gets them sent off.

How many shoulder charges happen now compared to 5 years ago? How many punches have been thrown now compared to 5 years ago?

Surely you aren't saying that rules have no effect on how the game is played?

Bullshit it was an illegal tackle, they picked him up and drove him into the ground head f**king first.
