Can a handicap person (ie a mentally handicap) even consent to sex legally?
In NSW you can't legally consent to sex if you are drunk so I would be curious if this would fly in NSW,I am not sure what the story is in Queensland though. Just wondering if anyone has more information.

FIVE Balmain Tigers players accused of gang rape have said the woman involved offered to sell her silence before lodging a complaint. The Daily Telegraph can reveal Queensland detectives are also poring over an extortion link to Sunday morning's events on the Sunshine Coast, which saw the NSW Cup players kept interstate for questioning.
The lower grade footballers are alleged to have gang raped a 23-year-old woman in a unit at the Rydges Oasis Resort in Caloundra on Saturday night.

Her father has also claimed that the woman is mentally handicapped.
The woman and her 20-year-old sister met the players at a post-match function at the Caloundra RSL. Witnesses have told The Daily Telegraph the majority of the side were drinking heavily.
The two women accompanied the footballers back to the team hotel after midnight, where the younger sister paired off with a single player. The woman then alleges she was gang raped by "six or seven" players.
Tigers vow thorough investigation
Another witness claimed to have seen a group of Tigers players with two women at a service station later in the night.
The un-named woman showed bruising to a TV crew to support the claims, while her father told Channel Seven she had been raped. But several sources close to the Balmain club told The Daily Telegraph the woman and her sister had phoned one of the players after the alleged incident.
"They basically told him that, unless the players came to the party, they'd go to the police," the source said.
It is understood all five Balmain players told detectives during interviews on Sunday that they were concerned about extortion.
They were released without charge after providing DNA samples. Balmain are confident the players will be cleared.
Superintendent Ben Hanbidge said an inquiry was "in full swing".
Also in town for a trial were Melbourne Storm players, who onlookers said were abused by the Tigers contingent.

Nope. Men can't give consent if they are drunk either. But this being said, you will be the first person to say that the law is ridiculously skewed for a paedophile.
What if the male and female were both deemed to be too drunk to be able to give consent?
Can they both be found guilty of raping each other?
And how is any individual qualified to determine whether someone has the mental capacity, or is in the right state of mind to consent in such cases? If one happened to throw themselves at the other, but was later found to be mentally impaired in a not so obvious way, but incapable of giving consent, what happens then?
