Leaving aside the sensationalism of the mysterious "nearby head" what has he done wrong?
Did anybody beside the police witness this horrendous event? If only the police shouldn't they be sufficiently resilient to such sights? Could they actually see his genitalia ?
I think these questions need to be answered before Gallen throws his arms up and the club comes out with scathing comments expressing their shock and dissappointment.
Gunna, you dont have to actually have a bystander witness the actions or be able to see his meat and two veg. You just have to show that the actions of the person would be 'offensive' to a reasonable person. Pissing in the street/lane easily satisfies that.
Its a bit harsh I know, whats a bloke supposed to do, piss his pants? However, its a big problem in the city, the place stinks of piss the following morning. Shop owners, toffs walking their dogs get upset. Like I said before, it was bad luck for Gall, he got caught on an alcohol blitz weekend. And I dont think he will be pay a cent either. Club just has to be seen to do the right thing, whatever that is.
4 [FONT=Arial,Helvetica]Offensive conduct[/FONT]
(1) A person must not conduct himself or herself in an offensive manner in or near, or within view or hearing from, a public place or a school.
Maximum penalty: 6 penalty units or imprisonment for 3 months.
(2) A person does not conduct himself or herself in an offensive manner as referred to in subsection (1) merely by using offensive language.
(3) It is a sufficient defence to a prosecution for an offence under this section if the defendant satisfies the court that the defendant had a reasonable excuse for conducting himself or herself in the manner alleged in the information for the offence.
