He deserved to get charged.
However, I can see him using Guerra's testimony as a defence. Whether it's successful or not is anybody's guess but given some of the judiciary decisions in the past I wouldn't be surprised.
Going back a few years here, but I remember JT was in a similar position during a finals series. Put a Warriors player in a dangerous position, it was a spear tackle for all the money in the world yet was somehow found not guilty at the judiciary. The Cows still got pumped by Manly but it goes to show that it isn't unprecedented and the Cows can't really complain if he does get off. In fairness, I don't see many wanting him suspended. They want the Broncos at their best, just as much as we want the Cowboys at theirs, so the best team can win on the day, no excuses.
