The courts will look at it and apply a well worn test "if it is likely to cause ordinary reasonable persons to think less of the plaintiff or shun, ridicule or avoid her". Another test applied by the courts is whether the words have "the tendency to lower the person in the estimation of reasonable members of the community".
So do you think that the court will find in her favour, that the hooka looka mooka hooka fooka joke would not have been taken by a reasonable person as racist and hence she was defamed ?
