I too thought Wade Graham was overdressed for the occasion. Obviously the club wanted to send a public message about their thoughts on the whole process so far.

The cap and thongs were a great touch. Some won't be happy about it. Tough shit.

Advice for Sharks players to boycott ASADA

A SYDNEY lawyer has strongly advised Cronulla Sharks players not to supply any information that may incriminate themselves — and not to do any further interviews with drug agency investigators.

Forward star Wade Graham was the first of 10 players given Australian Sports Anti-Doping Authority (ASADA) interviews yesterday in Sydney, accompanied by his lawyer.

The Sharks and their managers have agreed to the 10 being interviewed, with the NRL stepping in last week to expedite the interview process after ASADA officials wanted to delay proceedings, and sought a day for each of the 10 players.

The Leader understands that all players have a different lawyer.

However, lawyer Zali Burrows strongly questioned the NRL agreement with ASADA, telling the Leader players were under ‘‘no compulsion or contractual obligation’’ to attend interviews.

‘‘The NRL is ascribing to make it a compulsive investigation, yet the ASADA Act does not provide to compel a player to a coercive examination,’’ said Burrows, who was contacted independently by one player.

‘‘An ASADA interview is voluntary, it is not under oath and without caution.

‘‘ASADA cannot compel witnesses to attend or waive privilege against self-incrimination.

‘‘In that context if the player is a non-attendee and it is deemed to be a contract breach, that is nonsense.’’

She said ASADA did not have powers to conduct coercive questioning. ‘‘Requests for interview are merely an invitation only,’’ she said.

‘‘If this is a criminal investigation then the police should be [involved].

‘‘If ASADA assures players that they will not be asked incriminating questions then will they or have they been asked questions to incriminate others? This could be deemed a fishing expedition.

‘‘Adverse findings can destroy a career and devastate a player, and as such the NRL should not be a party to acting on any adverse findings that were founded by intimidation and a surrender of fundamental human rights.’’

Bruno Cullen, the Sharks’ interim chief executive who confirmed Graham was the first of the 10 to start interviews (away from the club), said he and Sharks’ football manager Steve Noyce had received advice that players would not have to incriminate themselves in interviews.

The job of these people is to collect piss. Who cares what you where when you are seeing them?

A lot of times a player sees an ASADA staffer they'd be wearing a towel.

Correct me if I'm wrong but I thought it was the NRL players agreement that compels the players to be interviewed and has nothing to do with the ASADA act

But what about showing some respect for your team and the game. I thought it was disgraceful what Graham showed up wearing.

Asda didn't show any respect for the team and the game. They have smeared the game, players and clubs without a shread of evidence.

Asda deserve nothing.

AFL Media does a PR job on the NRL again.

Essendon are about to release there own "internal" report to the AFL today with recommendations about what should be done to club officials and players etc.

This is clearly a move to pre-empt ASADA and thereby reduce there bans, if and when the come.

The media here is reporting this quite supportively and waiting for the fallout.

When the Sharks did the same thing 2 months ago, it was Wielder et al just abusing the Sharks for weeks on end until they relented.

The NRL anti-doping policy says this about co-operating with ASADA:



So "reasonable assistance" includes "cooperating fully". It'd be interesting to see how the lawyers try to narrow that down.

A couple of other things I found interesting while skimming through the policy:



So the standard of proof required is lower than in a criminal case.



And there is the possibility of getting more than the standard 2 year ban in some circumstances.

interesting interpretation of what is deemed to be guilty, the problem with that is that anyone deemed guilty by ASADA under their so called rules would then appeal the verdict in a court of law where they (ASADA) wont have things all their own way, it could then go on forever

just because they have not shown their cards at this stage, doesn't mean they dont have any

I cant see ASADA taking any notice of any internal reports. Easy for a club to cover any up in their own reports.

ASADA will probably end up at Essendon at some time in 2015 at the rate they are going. Their favourite strategy seems to be delaying or postponing.

I think they are already interviewing Essendon

Still trying to wrap my head around how this all works.

So the internal report doesn't even need to be submitted to ASADA, just AFL?

I imagine with their savvy legal & media team if they can remove ASADA from the equation they will. Just hand out some penalties (lighter penalties will be excusable because of their timeliness) and put it behind them.

Guess AFL players are less uppity than NRL counterparts and won't try and take on the might of their sport with an appeal either. They will cop it for the good of the game; be hailed as heros by their media on return.

Have all faith in D. Smith, he will be watching how the AFL situation unfolds. Could do a lot worse than following their lead.

Love the thongs, says 'I don't have anything to explain'. The times I wore a suit to court it meant 'Go easy on me, I didn't mean it'.
