If it was three games or ending my career early/2 years out, yep I'd take the plea and just keep telling the world I was screwed by the club then instigate a class action with the other players suing cronulla for breach of trust, psychological harm and damage to reputation. If I could prove I was given sht not meant for human consumption I'd also go after them for potential physical harm, that would be the biggie for a pay out.

Good luck proving it.

Maybe go after Dank, get that one in the witness box under oath. Maybe we would all get some truth then

Sharks ASADA case: Past and present players set to accept backdated doping ban

SOME past and present Sharks players are set to accept ASADA’s 12-month backdated suspension — subject to receiving eleventh-hour assurances prior to Friday morning’s 9:30am deadline.

While it is not certain how many of the 17 players in ASADA’s sights will take the deal, The Daily Telegraph understands the majority were leaning toward co-operating following a series of marathon meetings with their lawyers on Thursday.

ASADA has repeatedly told them the bans will not be challenged by the World Anti-Doping Authority (WADA), but solicitors acting for the players want additional safeguards to be provided first thing Friday morning, before agreeing to stand down immediately.

Acceptance means the players must sign forms to confirm they were given banned substances in 2011 — damning evidence that ASADA could use against support staff who devised and carried-out the 2011 supplement program.

However, the payback is generous. Instead of the mandatory two-year bans, players who co-operate will be sidelined for just three months, with their suspensions backdated until 21 November 2013.

After receiving their ‘show cause’ notices from ASADA on Tuesday, some players argued the return date should be moved forward to 1 November — the day new NRL contracts are registered.

However, ASADA refused to change its time frame, meaning representative stars Paul Gallen and Jeremy Smith will be unavailable for the end-of-year Four nations tournament should they accept the deal.

None of the five current Sharks players — Wade Graham, John Morris, Anthony Tupou, Nathan Gardner and Gallen — attended Thursday afternoon’s training session.

Gallen and Tupou were the only two named in the side to tackle Canberra on Sunday, but their chances of playing were hindered by respective biceps and hamstring injuries anyhow.

Tupou attended a legal conference in Martin Place on Thursday night, which also included other players who are represented by former ASADA counsel Richard Redman. Gallen is represented by a separate lawyer — Stephen Glass — and has more at stake than his teammates, with his high profile reputation and inclusion in the Kangaroos squad major considerations.

Other players who’ve since joined rival NRL clubs held meetings with their own lawyers, and it’s understood Gold Coast pair Luke Douglas and Albert Kelly are also leaning toward compliance.

Players who elect to fight have been given 10 days from Tuesday to challenge ASADA in either the Administrative Appeals Tribunal (AAT) or Federal Court. The NRL also has the right to enforce provisional suspensions while the appeals are on foot.

If they waive that right to appeal, they will immediately be deemed guilty under the NRL anti-doping rules and face a maximum two-year ban.

In 18 months ASADA hasn't been able to produce a single piece of evidence to prove any of that.
So how would you think a class action would be any different?

Players look set to take ASADA deal if WADA plays ball

Past and present Cronulla players were seeking assurances on Thursday night that WADA would not appeal if they accepted backdated suspensions for unknowingly taking prohibited substances.

The players also wanted to be sure they were not giving up their right to take legal action against the Sharks.

The 17 members of Cronulla's 2011 squad have until 9.30am on Friday to notify the Australian Sports Anti-Doping Authority of their decision and those who accept the 12-month ban, which expires on November 21, will be immediately stood down from playing in the NRL.

After initially being split on whether to agree to the deal, outlined at meetings with ASADA and the NRL on Wednesday, or fight allegations they took prohibited substances between rounds two and five of the 2011 season, on Thursday night most of the players appeared set to take the offer.

However, Fairfax Media was told the players were awaiting a formal guarantee that WADA would not overrule the bans, which for most are effectively a three-match suspension or less, and they could change their minds again.

The players are also considering legal action against the Sharks for damage to their reputations and embroiling them in the 18-month saga after they unknowingly took CJC-1295 and GHRP-6 as part of the club's supplements program.

Among the players affected are Cronulla's Paul Gallen, Anthony Tupou, Wade Graham, Nathan Gardner and John Morris, Newcastle duo Jeremy Smith and Kade Snowden, Gold Coast's Luke Douglas and Albert Kelly, and North Queensland's Matthew Wright.

Fairfax Media was told on Thursday that Gallen and Douglas were two players unlikely to agree to the deal, but some lesser-known players may do so in order to bring the 18-month saga to an end and move on with their careers.

"They are very 50-50," a source said. "Half of them are thinking they want to fight it. Half of them are thinking they can't be bothered. Every five minutes they are changing their minds."

By Thursday night, multiple sources said all of the players were set to accept the offer if they received the assurances from WADA – although Super League-based Paul Aiton and Ben Pomeroy, claim they are yet to be advised by ASADA they are to receive show-cause notices.

Aiton plays for Leeds and does not want to miss this weekend's Challenge Cup final at Wembley Stadium.

Others, such as Graham and Gardner, are out injured sowould not even miss a game if they were to accept the suspension.

Gallen is the Australian vice-captain and he would miss the end-of-season Four Nations, while Wright is eyeing his first finals series with North Queensland. It is understood Gallen unsuccessfully lobbied to have the ban expire on November 1, which would enable him to only miss the opening game against the Kiwis on October 25.

North Queensland officials are believed to have also asked if Wright could continue playing until their season is over and then serve the number of matches he played as a suspension at the start of next season.

The players have maintained they never knowingly took any prohibited substance, and some are likely to challenge the allegations if they don't receive the assurance from WADA.

Fairfax Media had been told that ASADA's evidence was considered flimsy and the players would have a good chance of beating any charge laid against them if infraction notices were issued by the NRL compelling them to face an anti-doping tribunal.

The majority of the players met again with their legal advisers on Thursday to discuss how to respond to the show-cause notices and the offer presented to them by ASADA on Wednesday, which many view as an opportunity to bring the saga to an end.

I think there will be more players taking the sharks to court after this. 10 plus former players accepting bans for the clubs supplement program and the coach who was in charge will still be employed by the sharks.

Back dated suspension is a f**king joke, these drug cheats should get the appropriate suspension if they are guilty! They should be dragged through the mud like Lance Armstrong was.

If they are not guilty ASADA should f**k off and I hope the players sue!

If Gallen accepts the ban does he get stripped of the 2011 dally m lock award?

Will also be striped of RLIF loose forward of the year awarded in 2011?
