We are very close to showtime. Our long national nightmare is almost over. Today is judgment day. Any punishments to clubs will be handed very soon. Players will get it if they get it very early in January.

The sooner the better. This has dragged on too long.

Your timeline for the end of this has always been a nightmare. Do ya reckon you've got even close this time?????

Darren Hibbert, aka the Gazelle, brings forward interview with ASADA

Date
December 12, 2013

Chief Rugby League Reporter

Darren Hibbert is scheduled to be interviewed by the Australian Sports Anti-Doping Authority on Friday after his legal representatives fast-tracked the meeting to help resolve the ElephantJuice scandal.

Hibbert, an employee of Advanced Sports Nutrition and an associate of Stephen Dank, was originally scheduled to appear before ASADA on December 19. However, with the ElephantJuice probe threatening to drag on into next year, the man dubbed ''The Gazelle'' has welcomed the chance to tell investigators his side of the story.

''In order to be co-operative, Darren has graciously offered to move forward his interview to assist ASADA in their aim to have the matter resolved before Christmas,'' Hibbert's lawyer, Zali Burrows, said. ''The only reason he should be hauled before a government authority is to answer questions about his hairstyle.''

In an intriguing twist to the inquiry, a witness who complied with an interview request - but challenged a notice to produce documents - was informed on Thursday he could be liable for criminal prosecution.

The hardline stance is the first real test of ASADA's new powers, which include fines of $5100 a day for non-compliance. The maximum penalty for the obstruction of government officials carries a two-year jail term.

Burrows, who represents that client, too, said it was a denial of natural justice. ''It is my client's intention to challenge the constitutional validity of the entire ASADA process, in particular the validity of the notices that are being issued,'' she said.

''This has happened all so very quickly before Christmas. They want to ride roughshod over my client and not provide him with his basic human rights. If they are in a hurry to get this done, then why have they been dragging their feet for the best part of the year?

''We understand many athletes must be anxious to have this investigation finalised by the end of the year so they can enjoy Christmas with their family, yet my client complied with notice to attend an interview and was told the interview would not take place [but be] stood over for January.

''We intend to challenge the notice to produce documents, not because he has anything to hide but because the participants are denied their basic human rights.''

The NRL will hold a press conference on Thursday but not to announce sanctions against Cronulla. It was widely speculated that NRL chief Dave Smith would present the ARL Commission's punishments of Cronulla - which are tipped to include a large fine - following a commission board meeting on Wednesday.

Instead, Smith will front media to unveil the trophy for the inaugural Auckland Nines tournament alongside sponsors and players, including Todd Carney.

"Threatening to go into next year!!??" Thats shocking copy.

There is less than 6 days left of the "business" year.

This thing will still be going this time in 3 years let alone in a few weeks!!

Looking that way, especially with suspensions being handed down & some will not take that lying down (& nor should they ) & challenge it in court.

I thought the Sharks developement money was supposed to turn them into a powerhouse, just how much of it have they burned through already? Once its all gone how will they be better off?

the development will contain a retail section which will be providing money to the club.

I think the best thing it will provide is bums on seats. It is dead in the club on a regular basis (non-footy days) but with so many more people living beside it & visiting it for shopping, there will be a much larger inclination for people to go into the club & spend $.

Wow, Brisbane's recruiting class for 2014 just went to shit.

Between Kennedy and Ferguson they certainly can pick em.

Broncos haven't signed or even mentioned Ferguson, only Mundine has said anything, and most believe that was more about getting people to his fight.

Ferguson has been found guilty, Kennedy has not and from that article will fight the charge so again, until completely resolved will wait and see.

It's believed that any possible charges against Kennedy will not include use or trafficking, which were both levelled against Earl in late August.

Okay then, so what are the charges for?

Regardless, I doubt there's much we could of done in advance. ASADA should of been contacting us saying "don't be too keen to sign him" or something like that.

Yes because ASADA's primary concern should be to the Bronco's recruitment and roster.

well then I guess Roger Tuivasa-Sheck, Boyd Cordner and Sam Moa will be next in line then. The article doesn't say Kennedy had raised levels, he had personal training sessions, didn't know that would get you into trouble

ASADA has not issued any interview notices in relation to the tests, showing Tuivasa-Sheck, Moa and Cordner have no case to answer on that front. Subsequent tests taken by the Roosters have found normal levels for all three players, and have been supplied to ASADA.

The NRL Integrity Unit was also informed of the test anomalies several months ago. But any players with links to Darcy could still be in the crosshairs.

Kennedy used to live in the same Bondi Beach apartment complex as Darcy, while former Roosters lock Tom Symonds - now at Manly - shares a flat with ASADA's new man of the moment.

Kennedy has also emerged as a loyal supporter of Darcy. When Darcy opened a Nutrition Station protein shake and frozen yoghurt franchise in June, Kennedy promoted the launch and posed in photographs at the front of the shop with his old schoolmate.

We are clearly not being given enough information to know.

Mate, based on the media's performance on this to date this whole thing could be a storm in a tea cup or a massive issue (who knows)

I agree, just sick of peoples double standards on here, they are happy to go after opposition players, coaches and teams without any evidence with sensationalist journalism when it suits, but when it's their team, coach or player under question these same sources they happily use to attack other suddenly become what they truly are nothing.

I did read the article, it's grabbing at straws at best, how can that have anything to do with any charges? the only way it represents Kennedy is helping a mate get a job ( which he got fired from anyway ), promoting a mates Nutrition Station protein shake and frozen yoghurt franchise and posing for photo's. The article is nothing, you might as well have link to a picture of a pineapple
