The Supreme Court contract saga engulfing Will Hopoate and the Parramatta Eels

In the old days Mick Cronin survived on a handshake deal during Parramatta’s glory days.

Today Will Hopoate is fighting the same club in the Supreme Court over a controversial $2.07 million offer that the Eels effectively claim wasn’t worth the paper it was written on.

While it has been speculated that Hopoate will join Canterbury next season, the State of Origin winger remains in an NRL pre-season lockout with the dispute due to continue in court next Tuesday.

In what some might say is a sign of the times in the so-called world of professional rugby league, The Daily Telegraph can reveal the finer details of a stunning three-year offer that was put to Hopoate last April.

Documents lodged in the Supreme Court show that not only was an offer made by Parramatta, but it was signed by Hopoate and returned to the club.

But because a subsequent NRL Playing Contract, also signed by Hopoate, was never lodged with the NRL, Parramatta’s defence claims that it did not constitute a “binding contractual agreement”.

Parramatta’s defence filed in the Supreme Court that on April 9 Hopoate’s manager Tyran Smith was sent an “offer” for a combined package worth $670,000 for 2016, which increased to $690,000 in 2017 and $710,000 in 2018.

That figure included in addition to a playing fee, that the club would use “reasonable endeavours” to assist in securing Third Party Agreements that scaled up from $175,000 in 2016 to $200,000 and $225,000 in 2018.

Then on April 16 Parramatta’s defence claims Hopoate entered into a separate NRL “Playing Contract” that was worth $500,000 for 2016, $525,000 in 2017 and $550,000 in 2018.

But for some reason the two sets of figures don’t add up, even when you take into account the NRL’s controversial TPAs that the club cannot guarantee.

The most glaring shortfall was for 2018, with a discrepancy of $45,000 between the “offer” and the playing contract, while in 2016 it was a $5000 shortfall and then $35,000 in 2017.

Parramatta’s defence claims the Players Contract included “terms that were materially different to those contained in the offer”.

None of the figures were included in Hopoate’s statement of claim.

Regardless, Hopoate’s legal representatives are claiming that Parramatta informed Hopoate’s manager that the contract would be registered.

But it now has the potential to have significant ramifications on Parramatta’s finals hopes for next season.

The Daily Telegraph understands if the Eels are forced to pay any money to Hopoate it will then be registered on their salary cap for 2016.

That represents a considerable problem given the Eels are also currently trying to prove to the NRL why they shouldn’t start next season minus four competition points because of previous salary cap dramas that came to light in May — just a month after Hopoate agreed to the offer.

Parramatta parted ways with former chief executive Scott Seward in June.

The club has until February 29 to prove to the NRL that they don’t deserve to be docked the four competition points, but they can’t afford another salary cap bungle.

The Daily Telegraph attempted on several occasions to contact Hopoate’s legal representatives without success..

Parramatta chairman Steve Sharp told The Daily Telegraph last week that the club had moved on from Hopoate, and was confident it would meet the NRL’s governance guidelines.

Asked for his thoughts on the tangled mess, Cronin said: “What do you say, it is the way of the world. It is a farce.

“I come from a different era.

“It is a bit of an indictment on the game but it might be an indictment on society in some ways.

“Once upon a time you signed a contract and you’d honour it.

“I preach loyalty but it happens on both sides now.

“You can’t say it is just the players, and you can’t say it is just the clubs.”

Souths knock back Dylan Walker’s request for an immediate release

SOUTH Sydney have refused Dylan Walker an immediate release to join Manly after the Australian Test centre was offered a four-year deal to join the Sea Eagles next season.

Walker looked like being squeezed out of South Sydney as a result of the Sam Burgess-sparked salary cap saga.

But just days after he was told he could talk to rival clubs as Souths attempt to free up salary cap space to accommodate Burgess’ return, the Rabbitohs have performed a stunning reversal and have now denied Walker a request to be released from the final season of his deal.

Walker was told on Wednesday he would be staying at Redfern until the end of 2016 despite agreeing a deal to join Jamie Lyon, Daly Cherry-Evans and Brett Stewart in a potent Manly backline next season.

But in a move that has left Manly officials upset, coach Michael Maguire has returned from a trip to the UK and told Walker he would not sign his release papers.

Walker’s manager refused to confirm or deny the South Sydney situation when contacted on Thursday night.

“Sorry but I am not in a position to make any comment whatsoever on the Walker-Souths situation,’’ respected NRL agent Allan Gainey told The Daily Telegraph.

“The club may be the only avenue for comment.’’

Despite the setback, Manly remain confident of snaring Walker for 2016.

“Give it 48 hours, things will change,” a source close to the deal said yesterday.

It is understood Walker wants out of Redfern and is hopeful Souths will still be forced to let him go despite Maguire’s desire to keep him at the club for at least one more year.

“It is a delicate situation,’’ said the official.

“Lots of things are in motion and the pieces need to fall in place.’’

Walker was expected to be the latest in a line of Sea Eagles signings after it was revealed the club was manoeuvring to offload players including Jamie Buhrer, Peta Hiku, Brenton Lawrence and Josh Starling.

Maguire did not return calls on Thursday night.

The Rabbitohs are now expected to turn their attention to their forward pack with Chris McQueen rumoured to be the player in their immediate sights.

The former State of Origin forward has been linked to a Queensland homecoming with the Gold Coast Titans speculated as a potential home.

Penrith, St George, Parramatta, the Gold Coast and Melbourne had also expressed interest in Walker.

Any money we have to give to Hoppa shouldn't come out of the salary cap - we should chase Scott Seward for it in court, and he make it right with Hoppa from his own personal funds.

I'd rather take James Roberts than Walker.
For the money we were offering Hoppa we could of picked up Walker and Simona. Instead we got stuck with No one and Morgan :crazy:

Notice Bart is blaming Seward :lol: So was he the one that made Hoppa a priority and on that sort of crazy cap breaking cash??? I'm sure no one else had anything to do with it.........

Once he failed at Fullback we should of been looking to move on or only offer him less then half of the crazy deal that he was offered.

if we are forced to pay him then he should be forced to play for us

he can't have it both ways

We pay players to play for other clubs all the time, and have those payments assessed under the cap.


Any amount that we are forced to pay him will be in the form of damages (i.e. the difference between the amount promised by the Eels and his earning power at another club given the loss caused by the fact that other clubs have less cap room now).

Which moron would ever think that Hopoate is worth that money??? I'm flabbergasted.

You might want to talk to your mate who told you there was nothing in writing :)

Hard to believe that Seward was the only person at the club who had seen the terms of the 'offer' document and unregistered NRL contract. And even if that is true, it once more speaks worlds for our governance structures.

If it's true that hoppa signed a contract then we are up the creek without a paddle. We will be paying him to play at belmore. Can't see anyway out of this other than a miracle.

If Hoppa's camp think they have such a strong case, why are they always going to the media. What purpose does this serve ? You would only do that if you did not think you were in a strong position and wanted the matter to be settled before it went to trial.

IMHO anyway.

I think what has been said is that there were emails exchanged and Hoppa's manager completed a pro forma NRL contract and wrote in the numbers that they understood the offer to be, then signed it. They sent it to Parra and they just sat on it etc.
