Hey guys, i have a question for you all.

I am going in for some surgery soon and i will need some time off work. It is for an injury i sustained before i started working where i am at the moment. I have not had any other time off while ive been here or am i claiming compo or anything. I need 2 weeks off and i am owed enough Personal Leave and Annual Leave to be able to do it. Although, my boss seems to believe that because i did this injury before i started working for him that i need to take it ALL off with my Annual Leave.

He has agreed on the dates, but i am under the impression that if i am unfit for work and have medical documentation to prove it, plus the Personal (Sick) Leave owed, i should be able to take it no worries.

Who is right?

You are. If you are sick you are sick. He cannot make you take annual leave.

As for the personal leave, you're sweet. You've accrued the leave, and you're unavailable for work due to a medical issue. End of story IMO, but might be worth checking with the Fair Work Ombudsmen just to check for sure. Were you asked to disclose pre existing medical issues when you were hired?

Nah i wasn't asked to disclose any but i told him that i did need an operation and he was all sweet for me to have it, he still is.

I was going to call the FWO but i will be speaking to him about it tomorrow morning before they open.

I'm on the same page as you two, but ive been thinking about it that much i was starting to second guess myself.

I'm having enough stress with the whole surgery part, the last thing i need is this shit.

and he shouldn't be upset in any way - if you have been there long enough to accrue 2 weeks leave then you've been there a while - not like you have dropped the "oh I have to take 2 weeks off" a week into employment

don't stress about surgery - my theory has always been, they can do what they like to me once they knock me out, I won't know :sarcasm: .... you'll just have a nice sleep and then wake up

Yeah, i had surgery years ago and after i woke up and went home i went back to bed and had one of the best sleeps of my life lol.
