So he didn't deliberately lift the player, is that it?

Of course he didn't mean to hurt McKinnon. But he deliberately made a lifting tackle.
it is my belief that he did not go into that tackle intending to make a lifting one

Might want to watch the tackle again.

He makes a very clear second effort after engaging in the tackle to slot his hand between the legs and lift.

He had a few million raised from the NRL. Has a job for life and he wants more despite every player knowing there is a risk of injury or even death. Severe injuries very rarely happen. But the possibility will ALWAYS be there no matter what the NRL do.

Parents will prevent kids from playing the game altogether because they know it's a contact sport and theres a very decent chance at injury.

Its a sad situation. But he was being paid more than an average person would earn to play the game he loved knowing it's a dangerous contact sport and things can go wrong.

If the sport had turned its back on him I could understand him suing. But they have done a lot to help him and guaranteed him a job for life. 99% of people with that injury don't get that help or those guarantees. Unless they lied about his job for life... which i can't see them doing so soon after promising it.

Job for life? Mate anybody who breaks their neck at work and is a quadriplegic as a result should not have to worry about working at all. Yes some people may get less help than Alex when they sustain similar injuries but so what? Should he not try and improve his situation because of that? Maybe he should turn down the job offer and give the money raised back to the nrl and the fans.

This has already been played out in the court of public opinion; in the aftermath of this whole horrible accident the large consensus was that McKinnon ducked his head, McLean contributed his injuries.

So I want to see justice done. Actual justice. Not the sort of justice that was afforded to Cameron Smith by Channel Nine and McKinnon himself. Not the sort of justice that was afforded to McLean by that piece of human excrement on Channel 7 who ran the sensationalist piece on him on Grand Final eve. And I want McKinnon to get what he has coming to him to live out his life as productively as possible.

Let McKinnon lawyer up. Let the NRL lawyer up. The consortium that owns the Storm should back Jordan TO THE HILT and give him the best defense he's entitled to.

And while we're at it, let the referees officiating that match lawyer up and be scrutinised in equal measure. As I recall there were several players put in compromising positions in the game before McKinnon was and they didn't even raise the ire of the refs. Maybe if they'd acted appropriately earlier this would never have happened.

I'm no lawyer but I would be suprised if this ever sees the inside of a courtroom. The NRL don't want the publicity and McKinnon isn't going to want to be put through the cross examination he is bound to get re: his contribution to his injury. Sorry, it's harsh; but that factor is part of the collective conciousness of the rugby league public and any competent solicitor would be foolish not to take advantage. I guarantee this will be settled out of court

I too can't see how the NRL could be made culpable for this. They govern the game and the exact act that McKinnon was a victim of, a spear tackle, has been illegal since the inception of the game. I'm no legal expert but to me it is akin to suing the government because someone was speeding and ran you over i.e. blaming the governors of the law for someone breaking the law. If the act wasn't against the rules of the game then he may have a point.

McLean is probably an easier target. I don't think anyone can say it wasn't negligent at best so he probably has a fair chance there.

It doesn't sit at all well with me that he was happy to take millions of dollars of charity including rehabilitation costs and a life job and then turn around and sue everyone he can. Having a partner in the social work sector, I can tell you there are many people, including lower grade footballers who have suffered similar injuries and have not gotten anything from anyone and live very undignified lives in shared housing. I really do feel sorry for the bloke and I am sure I will have my detractors for what I have said but it feels like double dipping to me.

The question for me is, did McLean actually break any rules, it is very much debateable wether or not he lifted over the horizontal, if they can somehow argue away McKinnons contribution to the injury by bending at the neck to point his head towards the ground then there might be a case that the current lifting laws are inadequate

He can support himself longer than a decade with a life job and by no means are people required to self fund disability services in this country but we don't need to get in to the ins and outs of the disability services in this thread.

As for the NRL not taking it seriously, I am not sure how you prove that and what metric would be identified by all parties involved as them taking it seriously?

Say they introduce a mandatory send off and 8 week suspension and the same thing happens. Do we think the victim doesn't sue? I doubt it. Perhaps they suggest a full season suspension as proof that they take it seriously yet it may happen again... where does it stop?

As far as I'm concerned the line in the sand was drawn when Jordan got three weeks for the actual tackle and four for the injury caused.

Make it an automatic 3 weeks for a lifting tackle without going to the judiciary, I say.

Yep... he ended up with a public on air apology and Nine/60 minutes were rightfully pilloried (I even found myself in agreement with the late Beccy Wilson over her opinion piece on it which is a first and obviously only time). That should tell you all you need to know about the integrity with which "The Home of Rugby League" handled that.

I don't know what financial gain he expects to get from a bloke who earns just over $200k a season. Certainly no where near enough to cover Alex for a sustained period of time if he's after millions

I am certain he is not trying to and has no intention of getting a cent from McLean.

It would all be legal strategy.

Something along the lines of, the NRL would claim the culpability lies with McLean as he made the tackle. By putting them all in the basket to be sued, his lawyers are mitigating the risk of any loopholes.

If I had to guess.

Integrity and the media don't mix, similar to how integrity and Cameron Smith don't mix.....

Anyway the people who think Mckinnon should just be happy with what he has are kidding themselves. Every one of us would do the same in his position.

When Mckinnon's head hit the ground, McLean was still holding his leg in the air. I'd say that put him passed the horizontal, wouldn't you?

McKinnon didn't take effective evasive action after being driven head first into the ground. He in no way contributed to the dangerous and illegal tackle executed on him.

I doubt any lawyer would dare make a fool of themselves by bringing that up in court anymore than they would try and blame a pedestrian for not tucking and rolling after their client hit them with their car

They should probably be thanking their lucky stars it isn't the other way around.

Again; I care about justice. The way this whole thing has been handled since 2014 proves that nobody has got any justice

Cam Smith is a scumbag, I don't know why anyone would defend him. Rubbish human...I suppose some weird folk respect shit humans
