There is NO chance Flanagan would fail a performance review if it was done today, or if it was done in two months. Maybe an improvement in support staff and coaching structures would be put in place for next year, but he'll be here for 2017 and it would be mad to not allow him that after the last three months of results (although the actual performances for the most have been worrisome).
I have no doubt he'll be here next year, however that isn't the subject of the thread, it is "anyone still want to sack Flanno", which I do. At least I'm not hiding like most of the people who were critical of him. Though I'm also not personally attacking him and saying he's the worst thing for the club either.
If the club wants him gone and that clause is in the contract then yes, they can structure it so that he fails the review. I mean, there's probably argument enough in the compliance with Gordon and Taga saga.
You only need to win half your games to make the top 8. Making the finals shouldn't be your gauge of success. We are the only team in the top 8 to have a negative points differential. If we bomb out of the finals in straight sets what's the point?

Do I think another coach can come in and fix what needs to be done within a couple weeks and continue, no I don't. Flanno is best poised to keep the ship steady and see where we end up.
Do I think another coach could do a better job with a full pre-season at the Sharks under his belt? I sure do.
