You are probably right but the ato might not consider dodgy payments to players a legitimate deductible expense so there could be a difference.

Still had to get the over-paid amounts out of the company and into the players hands somehow; while the companies may not have directly avoided tax (as you said it evens it out); they were still complicate in arranging to give the players (allegedly) undeclared income.

If the owners of said companies took it out (as their own declared income) and passed it to players in brown (allegedly) paper bags; I wonder if the ATO would be so kind as to allocate those franking credits onto the players when considering their possible undeclared income .

Good point - what they should actually do is strip the For but leave the Against.

This is a minor quirk, but otherwise the penalty is 100% fair.

The problem is that's essentially how you describe every single person involved with the club politically. There is no doubt this all came about because of one of these merkins. Obviously we can't name names here, and obviously we were breaking the rules. But the kind of person who runs at board level is exclusively the kind of person who gleefully leaked this stuff to the media and is watching the club burn to score themselves a little bit of a revenge boner.
