To me it depends on what is in their social media policy, any other policies that may be applicable, etc.
There is such a policy, and AFAIK it is still available online, but it is nowhere near specific enough that you could be sure one way or another what a court will decide in the circumstances.

That’s two separate issues though isn’t it.

If I read what you are saying correctly, then the only way to change that would be through legislation I imagine. But in saying that, if we all had carte Blanche to say as we feel, imagine how organisations who rely heavily on sponsorship funds will go. These sponsorship funds contribute heavily to the player payments. Imagine if players went on twitter and tweeted things that customers of Foxtel who contribute enormous monies to the NRL and therefore the players found offensive. Imagine if those customers took action by unsubscribing. They need to protect themselves commercially, otherwise how do to sustain the revenue to pay the players what they are paid?

I feel the real question is whether Rugby Australia has covered themselves either contractually or via their policies.

Maybe Rugby Australia has sold itself short. To appease Qantas it fired Falou. In three days he has had the annual equivalent of over $67mi;;ion towards his legals. Maybe falou was worth more to RA than Qantas

To be honest I do not care about the reputations of big organisations, I have a greater concern for for people freedom of expression. Why should an organistion have a right to tell a person what they can say in their own time. If he was expressing these views in his interviews after the game or in his role as an ARU employee then they would have a point. When he is own his own time they can back out of people's lives.

There’s two sides of the agreement - Folau performs as a rugby player and is bound to the conditions of his employment, and Rugby Australia pays him. Can you imagine the reaction if Rugby Australia decided they didn’t want to pay him anymore? But you seem ok that Israel Folau did not want to honour what appears to be his side of the agreement.

That is not what I am saying, I'm saying I do not believe those things should be in his agreement in the 1st place. Look at it from the other end of the scale, someone who is on minimum wage that is part of a union and fighting for the right of other workers. Should an organisation have a right to censor what they say? The fact that Folau is on a large contract is irrelevant. Should an organisation in a small community have a right to stop someone preaching about their religion in their community?

These agreements if done right are to protect the interests of the organisation and the players. I am not sure how it is done in RU but for example, before the No Fault stand down policy could be enforced, it needed to be endorsed by the RLPA.

earlier in this thread I asked what is next if freedom to practice religion is stopped. I just read a council in Stockport, Manchester has ordered an 81 year old woman to stop wearing a Bikini (depends on figure:)).
Less than 40 years ago I headed a group representing certain lawful building projects. the protesters demands were subjective. I suggested it could be a future problem if the protesters wanted all buildings be triple fronted red brick. The protesters said that was stretching the bow, they would never get so specific. In that same LGA today you are told what material you can build your house out of, which way the front door must face and what side your paved driveway must be on, (NSW Coastal)
The principle _ who decides for us - this is what Folau is fighting for - freedom of thought and action. Choose wisely

Absolutely. It would be nigh on impossible to attract high paying sponsors without these agreements. It’s a big way they moneytise their product and therefore are a big means in protecting the players earning capacity.
