The man alleged to have provided peptides for the Essendon players during the club's secret injecting program says he has no intention of co-operating with the WADA appeal.
"I believe they don't have the power to compel people to appear," biochemist Shane Charter said.

"We won't be giving evidence. If we don't have to go then we won't be going."

ASADA's case was damaged when it failed in a Supreme Court bid to force Charter to give evidence at the AFL anti-doping tribunal.
The anti-doping authority alleged Charter bought the banned peptide thymosin beta 4 in China, provided it to compounding chemist Nima Alavi, who mixed it into doses for sports scientist Stephen Dank, who used it for Essendon players.
While it was established that Charter bought a product he believed was thymosin beta 4, the tribunal was not satisfied the banned peptide was injected into the players.
"This is a little like the field umpire making a decision and then going to the video replay," Charter said.
"Unless they have new evidence I don't see anything changing."
Is he correct? I thought WADA had the power to subpoena witnesses, which would compel him to appear or face gaol time.
If WADA practices what it preaches, they will pursue the AFL for the truth!
Earlier on Tuesday, leading Melbourne lawyer David Galbally QC, who acted for former Essendon fitness coach Dean Robinson in his lawsuit against the club last year, said if WADA won the appeal, the players faced two-year sanctions.
He called the anti-doping body's decision extraordinary, and didn't believe there was any new evidence to be produced.
Galbally said said the AFL was within its rights to reject WADA's findings.
"It could provoke a response from the AFL which is, 'We are not bound to follow the decisions of an outside body ruling us. We've already had this determined'," Galbally told Triple M.
"It's a total inconsistency by [ASADA CEO] Ben McDevitt in relation to the way he's going about it.
"It really doesn't say very much about the standards of ASADA, nor what's going to happen in the future if ASADA is going to be run like this."
Galbally described WADA's move as "a flawed prosecution".

Given they have no international comp I don't suppose pulling out of the International WADA agreement will be that big an issue for them. Someone mentioned the NFL don't subscribe to it either?
