How is it in breach ? Different sporting teams can share the same nicknames … and this is a team from a foreign country …
They'd participate in an Australian league and do most of their business in Australia, so straight away it's going to be very hard to argue that the brands couldn't be confused. By the sounds of things the PNG NRL side will probably be based in Cairns or FNQ as well, which will make it even harder. Australia would also be their primary market for selling merchandise, which is primarily what the NBL uses the brand for.

I don't know what more you want, the name is taken, the NRL can't use it, get over it.
There're plenty of other animals more associated with PNG anyway, e.g. singing dogs, birds of paradise, harpy eagles, cuscus, etc, etc, and I'm sure there're plenty of local names for warriors and the like as well, use one of them instead.

There is an Adelaide United In the A League and a Melbourne United in the NBL… somehow they both exist without suing each other over breach of trademark…

Never mind the Wests/ Collingwood Magpies ….Wests / Richmond Tigers and no doubt several others …

If the PNG team wanted to call themsleves the Crocodiles ..,then the NBL can go and pound sand over their defunct team

Wouldn’t surprise me if they just “promote” Hunters after all is said and done.

A lot of the good options are probably taken by Digicel Cup teams but I’m sure they could find something. Same with colours, going with Yellow, Red & Black the same as the National team and 2 next biggest clubs in Port Moresby would be a bit boring.

You haven't got the faintest clue what you're talking about, but I don't have the time to explain IP law to you, nor should it be my place considering that I'm no expert myself. So I guess you'll have to remain ignorant.

I'll give you a couple clues though. You can't claim ownership of a common word, phrase, or concept, i.e. united. However if one of those teams were to copy distinguishing aspects of the the other's brand they could be in trouble.

The Tigers are heritage brands, put extremely overly simply they've coexisted for so long that neither of them can claim the other is in breach of the their IP, and there's no reasonable grounds to claim that the two brands are confused by the average consumer anymore. If somebody else tried to launch another professional sports team called the Tigers either one could get it whacked though.

There's almost zero chance that an NRL team called the crocodiles would get up unopposed unless they put in a concerted effort to make it unique, which is much easier said than done, and would likely result in a brand that doesn't look anything like the one you're imagining in your head. It wouldn't be worth either the effort or the risk considering the options available to the NRL, so move on and come up with a different idea.

Almost certainly what will happen if PNG does actually get a license.

Mate nothing we've talked about is even a molecule off the top of the IP iceberg.

IP law is a rabbit hole that's endlessly deep and easy to get lost in.

But I reserve the right to revisit with you if they go with the Crocodiles Name …

They wont, it will be a vague name that can represent both Png, Australia and the other islands in the pacific.... hunters maybe, but they want to keep that as the Qcup side branding only, they might go Pacific Hunters, personally i like Pacific Pride, and use the FNQ cup side branding, if its going to be there permanently, even if the licence is Png owned

The Cowboys wanted to use the name Crocodiles initially, but that is the name used by the NQ Union rep team, and decided not to use it or were blocked (I can't recall)

And No, the Townsville Basketball team at the time were called the Suns, so it wasn't them that blocked it.

Also remember when the Titans were to be branded the Dolphins and were effectively blocked from using that name?

It's not like there isn't precedent here

The PNG team must be a juggernaut in waiting that is going to destroy existing teams in the comp…

And some of us were worried that they mightnt be successful!

There's a history of cannibalism basically everywhere, in fact it's so ubiquitous that culture's without some history of cannibalism are the unusual ones. It's one of those quirks of human behaviour that polite society and academia likes to pretend is overstated or even didn't really exist, more myth than reality, but is actually a common behaviour, especially amongst hunter gatherers.

The only reason cannibalism is more associated with the PI's than some other places is because it was still a common within recent times in most pacific cultures, even within living memory, and in New Guinea's case (both West Papua and PNG) it's a very rare, but still extant, behaviour.

There's absolutely no chance that the NRL, or any other serious sporting organisation for that matter, would ever allow one of their teams to be called the Cannibals, nor was I seriously suggesting that they should be. The fallout would be f**king hilarious if they did have to balls to pull a move like that, and that merch would be an instant buy even if it was just for the laughs.
and then Perth can be the Cannon Balls
