Optus has declared it will appeal the latest TV Now ruling in the High Court, continuing a saga that is set to shape the future crossroads of technology and copyright law.
The latest decision to appeal is set to continue an ongoing legal saga involving the AFL, Telstra and Optus’ TV Now product.
“We believe the TV Now case is extremely important in deciding the future for innovation, consumer choice and competition” Optus chief executive Paul O’Sullivan said.
“As innovations like TV Now are readily available in other parts of the world, Australia must remain globally competitive and embrace the rapid convergence of technologies as we head towards an NBN world,” Mr O’Sullivan said.
“Australian consumers want legitimate access to content on any device regardless of the genre and we want to continue making the latest technologies available to Australians to meet this demand.”

7 has Mythbusters and Top Gear. And some way behind the US shows most people just download. And some old shows no-one cares about anymore, And Southpark, and twe Colbert Report, but they are never on when I'm watching the box, and I'm kind of over South Park anyway. Nope, Brutus is right. 7 is woeful.

If Optus wins the next appeal the law will be changed anyway. There's near universal political support against it.
I can understand why people would want a service like TV Now.
Cheap. Near live. Ad-free - but it's unsustainable.
If Optus were to actually pay for the rights to those programmes they couldn't offer it for anywhere near the same price.
Something like it will come in. They'll get a model up that won't infringe the Copyright Act.
Not with the current system and definitely not with playback within the original airtime.
Optus are getting a request for a specific programme and thus can't claim ignorance when they copy it. And mind you - it was also revealed that to save server space the TV Now system is designed to copy from a minimal number of original copies if requests are received from multiple users i.e. if 500,000 people request a copy of State of Origin, the system would determine the bare minimum amount of copies required for mailbox transfer (this means there aren't 500,000 individual copies at anyone time as per their original argument).
Same with me. I have spent too many years watching channel 9, thanks almost entirely to them having the footy and the cricket rights. That led to me watching other programs on 9, without ever being very aware of what was on other channels. Losing the footy will definitely have an impact on the ratings for their other shows too!
