Will Ipswich & Newtown be heading to court ?

You seem to have 3 teams. Bulldogs, Bunnies and Bears.

I support the Bulldogs. I support the Central Coast Bears NRL Bid (as i supported the Gold Coast NRL Bid).

I Just like the old Rabbitoh logo, thats why it is my avatar.

How is that the same thing? Have Ipswich been known as the Bears for 25 years?

Already answered this, go back and have a look.

Trademark law applies Australia-wide so the NSWRL comp vs QRL comp arguement or the example of Redcliffe stopping Gold Coast using Dolphins because they are both in South East Queensland also means nothing because it's not geography-based.

The level of competition a sporting team plays at also means nothing. So the fact that Newtown are never likely to be promoted to NRL again is also a non-issue.

For the Queenaladers that say that Newtown was part of the NSWRL and never the NRL, apart from the fact that the NSWRL competition and all it's records and statictics are incorporated into NRL records, it also didn't stop the NRL sanctioning the use of Newtown Jets logo for use on official NRL merchandise the game's 100 year celebrations in 2008 -

Also Newtown Jets Centenary football card (which came with the Select card collection), medallion, etc.

All 16 current NRL teams + 4 existing foundation teams, North Sydney Bears, Western Suburbs Magpies, Balmain Tigers, and Newtown Jets all had therir own centenary merchadise

Very good point. Newtown were a part of the centenary merchandise. I have the towell, football and coffee mug with "Jets" written across it. Obviously the powers to be recognise another team have competed at the top level in this country with the name "Jets". To have another new team enter the competition calling themselves "jets" does not seem right at all. Given this recognition of the Newtown "Jets" during the centenary I doubt very much that the game would allow a new "Jets" team that was not Newtown. Good luck to Ipswich in their bid, but not as Jets, pick something else.

Very good logical points that people just seem to skip through.

This. I'd say the fact Newtown didn't go about halting the use of the name by the A-League team says it all. You cannot trademark a generic name like Jets and the only reason the Titans ceded their use to Redcliffe was because it wasn't worth an ugly drawn out media battle for a name like the Dolphins.

The bid team will use common sense in sourcing a name for this team. They could use Lions if they bloody wanted to but the marketing problems stemming from having the Brisbane Lions and Brisbane Roar in the same city are obvious.

Smart post.

People seem to have missed a crucial reality here.

THEY ARE CALLED THE JETS NOW!!!

Newtown have not demanded a change and in reality would be stupid to considering they ripped off their name from NY Jets. It is also likely that they have no grounds to. There is nothing that infringes on their mark. The name itself "Jets" Can't be trademarked. They would have to prove that the new (which is not new at all) mark would infringe upon their business.

Also I don't think that the Dolphins issue even made it to court, it was settled not as a legal dispute but in reality because of bad publicity for the GC bid team.

At last! A well thought out response to an obvious troll thread perpetuated by some illogical posters...

A salient point is that you can buy NSWRL, and perhaps NRL, endorsed merchandise for the "Jets". Ipswich Jets NRL gear could convievably cause confusion and should/would be disallowed.

South Queensland Diehards, they could then have the 'Newtown' jersey anyway and pick up Valleys fans!

or Brisbane Diehards.

So what do people want to call the Ipswich/ SQLD team???

my $.2

1. Dingos
2. Hornets (just throwing it out there, something different)

Diehards by a mile.

I would be very happy with the Brisbane Direhards. Much better than Jets. Hopefully it is one of the options because I think it would win by a mile.

I bet it is a gorgeous towell too.

After the above comment, end the thread.

Brisbane Diehards would be a winner, it really must be a "Brisbane" side. Ipswich is not big enough to sustain a side, they must embrace Brisbane to ensure long term success. Crushers would also work, I work in Brissy and many "Brisso's" would love to see that moniker used.

Boy we have some legal experts here on this forum don't we.

The notion that Newtown may have a case against Ipswich for using a term they have consistently used for decades is absurd in the extreme. One needn't have any knowledge of law to see through the holes in any possible argument.

I'm certain we can expect to see an "it was a joke thread" statement or "doesn't matter, Ipswich won't get in" deferral from the OP sometime soon.

We shouldn't let this petty discussion distract us from the fact that an Ipswich bid is vastly inferior to the possibility of a second Brisbane side.

I think BDGS must work as a Legal Secretary... he definitely comes off a little effeminate like a secretary would.

It is a lovely towell Johnsy, gets many a remark on Burleigh Beach. You seem like a man who possesses common sense....the same cannot be said for some posting here. The Jets name in top level rugby league has been used before by Newtown. Yes they are gone from the top level and now play the next level down in NSW Cup. However there is a thing called history and tradition as shown by centenary celebrations/merchandise recently. The "Jets" in top level rugby league were Newtown, nobody else. As I previously posted I am not anti Ipswich. The area has a high growth population and is a true rugby league area. They may be successful in playing top level rugby league in the future, good luck to them.....just do not call them the jets.

You'd like to see them go the way of the dodo for no reason wouldn't you?

And you call yourself a fan.

Um, I was merely referring to the point that they won't die, not that I wanted them to die. Sorry if you didn't understand that, mate.

They have been doing just that for the last 25 years. Where have you been?

You don't get it do you.....Ipswich have been Jets for 25 years BUT NOT AT THE TOP LEVEL OF THE GAME! They were Jets at a Brisbane RL level at first followed by Qld Cup level in more recent times. They can remain Jets at a Qld Cup level, good luck to them, no problems there. If they make the step up to NRL level they should change names. Jets have competed at the top level, they were called Newtown! Its all about protecting the history and traditions of the game.

Agreed, but for the reason's outlined by Greg i don't think they should. South Queensland somethings-Diehards makes sense to be.
