it wasn't a defence or otherwise of the AFL it was merely an illustration of a clause that exists in the AFL (and most other professional leagues worldwide, NFL, MLB, etc etc) and a wonder that the NRL might possibly have the same sort of clause buried somewhere that would allow the NRL to act without waiting for the outcome of a court case. Whether the AFL use it or not, or how they use it, was not the point.

so before you attack me you under educated troglodyte, try using the single brain cell you might have and don't read things into a statement that don't exist.

Your the genius who brought up the AFL' code-of-conduct and using it as a template when the fact is the AFL never use it and the NRL are far stronger on offenders the the AFL ever is.

No it wouldn't. It is the same as firing a gun randomly into the air. If you hit someone with the bullet, you intended to fire the weapon, and you knew the consequences or the potential that it may hit someone.

If he 'intended' to throw the glass, that's all that matters, because he would know the risk is there that it would hit the victim.

However, it may mean more leniency at the sentencing.

And that would be the difference between murder & manslaughter and the diference between spending 1 year in jail and 20, so theres a massive difference. I think.

He brought it in to simply say the NRL would have a similar thing written into their contracts so it would be all clear for the Sharks to sack Bird straight away.

The difference between murder and manslaughter is manslaughter would be your missus was pissing you off and in temper you through a glass at her face or held it and stabbed her.

Murder would be if the day before you decided when your missus walks in the front door you are going to ambush her and stab her.

There won't be any jail difference between holding and throwing a glass.

In this case it would mean the difference between reckless or intentional GBH

Maximum 14 years for the former, maximum 25 years for the latter
