So she claims she passed out and doesn’t remember much, after being heavily intoxicated. Does she have to say yes for it to be consensual? Or the fact she was heavily intoxicated and forgot to say no, is playing on her mind. Guess it’ll be payout for her.
America (and Australia as well IIRC) has instituted laws where if an individual convinces an intoxicated party to have sex and upon sobering up the second person decided they didn't want to have sex, it then constitutes as rape.
I am not jumping to conclusions either way here but unfortunately Hayne's name is tarnished forever more, regardless of innocence. Rape claims have a nasty way of sticking (before any Canterbury jokes come at me, I do remember Coffs Harbour), even if the criminal aspect of the charge has already been dismissed.
Sexual misconduct and violence is absolutely at home in the NFL but by another token, false rape claims are a very real and rising issue in America so extremists on both sides need little prompting to attack or defend Hayne. I am going to afford him the right of being innocent until proven guilty and I am happy for him to play for the Eels until shown evidence otherwise.
The trial by media is going to make the off-season and preseason drag on though.
