I love these convenient traditionalists who refuse to accept that contracts as they used to be are dead and buried. In most cases, they aren't worth the paper they're written on. In fact, they have been dead since Gordon Tallis sat out the year.

It actually proves you don't know much about employment law. If anyone signsan employment contract it can be enforced in a court, however it can't be used to force a person to do something they do not want to do e.g. If a player under contract to a particular club, mid-contracy decides that they do not want to play for that club, a court cannot force them to play for that club. However the court can prevent them for playing for any other club during the period of that contract and the club will not have to pay that player whilst they refuse to play. Hence Tallis sitting out a year.

However for a court to get involved, the club concerned has to commence legal action. That is where the issue lies as too many clubs decide against doing so.

Love it, the Broncos are becoming a threat again the whinging has begun. Soon we'll hear how the over rated players like Thaiday, Glenn, Gillett, Hannant, Kennedy, McCullough, Hunt, Reed ect are all great players that should be costing the Broncos a fortune, they are superstars and the Broncos who no one expects to make the 8 next are cheating the cap ect.

Lol Kennedy is getting a lot more at the Donkeys than he was at Easts.

Josh Hoffman is in a different category to Barba and Milford.

Milford wanted to return to Brisbane for family reasons - he had a clause inserted into his contract to do this.

Barba wanted to return to Brisbane to be with his wife and get his life back on track. It's debatable whether this is a legitimate reason for breaking a contract, however Todd Greenberg called a press conference proclaiming to the world that Ben Barba was ill and dealing with life long problems. At that point Canterbury backed themselves into a corner.

Josh Hoffman is not seeking to leave the club for compassionate reasons though, he just wants to play fullback.

If he had deep personal problems and wanted to return home to NZ, then yes the Broncos would be hypocrites.

Milford has a clause in his contract relating to his father's health and he's trying to exploit it. His father went from death's door down to watch his son play in Canberra in the space of a week.

Actually the family court system could have prevented his ex from leaving the state with their child without his consent. He allowed it to happen and then kicked up a stink about him having to chase them.

most fans get narky when their club is attacked by other fans, it's a vicious cycle really, fans seem to feed on this and attack when but cry and sook when on the receiving end. It is quite humorous to watch really.

I think its just a case of people sick of their double standards mate. Believe me I don't think too many are shaking in their boots at the prospect of playing the Bronco's next season. :D

we'll see. Wont take long before the usual cap cheats, one town team cries happen again.

LOL well clearly your dipshit clubs don't understand how the law works because they allow these clauses to be placed in their contracts to satisfy the player that they have no intention of ever honoring. Too bad for them the player doesn't need their f**king approval.

Just for clarification, of course I'm talking about Canberra and not Canterbury who don't lose players because of contracts, they lose them because of club cliques that make players feel ostracized.

If there was a clause allowing milford to terminate the contract wouldn't he have done so already.

The contract has not been terminated because the clause requires both parties to agree to it, a different thing altogether. Thus the contract still stands and Brisbane seem to think it is worthless.

As far as I can see Brisbane actively encourage other clubs/players to shit can contracts when it suits them and then tells players to stick to contracts again when it suits them. The law doesn't come into it.

They just deal with matters with a complete lack of integrity and if the NRL sticks up for contracts their club will go further down the drain then it already is.
