this has nothing to do with what's legal as they aren't the police

it's about what is in the agreement all clubs sign and if handing over your private phone is in that then them's the breaks

I've heard it all now. "It has nothing to do with what's legal", haha fmd. I'm retiring from this thread after that beauty.

I could go and start a company and put in the employment contract that all workers are allowed to drive to work at 140kms an hour

When the police arrest them, all they need to do is produce the employment contract as what I put in there supercedes the law.

a lot of lawyers out there say a salary cap isn't legal as it's a restraint of trade just like the draft was

Hmmm all this back and forward about legal or not legal, isn't the issue here has there been any salary cap cheating?

Not much of a defence to say, ha ha sucked in NRL you can't have access to something that maybe, just might, show we did something wrong?

Seem a double edge sword to me.

We didn't cheat, but no we won't let you find that we might have.

it's the NRL's comp and they make the rules

The NRL or any other organisation can put whatever they like in their contract.

But if what's in the contract is a contradiction of common law, it holds no water if contested.

If nobody contests the validity and accepts it, then its OK. But if it does get contested and is found to breach the common law then they cannot compel anybody to abide by it.
