Crimes Act 1900 (NSW) Indecent Assault

The Crown must prove beyond reasonable doubt that the assault was indecent. The word ?indecent? means contrary to the ordinary standards of respectable people in this community. It is for you to determine the standards prevailing in our community when deciding whether the Crown has satisfied you beyond reasonable doubt that the act alleged in this case was indecent.

For an assault to be indecent it must have a sexual connotation or overtone. If [the accused] touches [the complainant?s] body or uses [his/her] body to touch [the complainant] in a way which clearly gives rise to a sexual connotation that is sufficient to establish that the assault was indecent. For example, touching the genitals or anus of a male or the genitals or breast of a female.

So innocent players are now having their registration suspended. If he's guilty the nrl should take action but this is madness. Why couldn't people just make allegations against random nrl players in future hell probably be a good way to extort someone. Don't even need to be guilty just charged.

Alleged CCTV footage of alleged incident would have to be pretty conclusive ?

Tamou and fergo had barely any impact in the first game really. I would say that missing Tamou is probably a good thing, woods deserved the spot in front of him in the first place.


This. And in reality, it gives NSW just one day less to prepare for Origin with the squad they are going to use. Qld haven't even named their side yet!

I really really hope the Raiders play him this week against the Tigers (unless he's banned by the NRL)

Let the courts handle it, let the NRL dish their sentence out, add a 20k fine from the Raiders and move on.
Sacking him will hurt no one (including him btw) but the Canberra Raiders.

The NRL have played their hand with disgraced footballers, time to play ours. We can continue to be nice guys and finish last, or we can get on with the job of trying to win a premiership.

The National Rugby League has suspended the registration of Canberra’s Blake Ferguson over repeated behavioural issues involving the abuse of alcohol.
Ferguson will not take part in the second State of Origin game and the NRL will reserve its decision on when he may be able to resume playing until it is in a position to assess any further relevant facts with the Canberra Raiders and the NRL Integrity Unit.

Sorry to say , my early impressions of David Smith are looking increasingly wrong.

Major , major f*ck up from the NRL.

Suspend him for the rest of this year, but round 1 2014 he should be running out in the lime green.

I will be furious if the Raiders sack him

You need evidence strong probability to be charged by police.

You can not wait for everyone for every court case as you could have guilty criminals playing.

It's not just a matter of police evidence. ( and you're clearly forgetting the Brett Stewart case)

It's a matter of prejudice.

This decision is crazy.

We're playing in QLD gents and two of the playing group are not going to be playing due to incidents with alcohol. We've lost our fullback who was simply outstanding in game 1. The preparation is already in dire straights and the media pressure is only just about to begin. We have a very ordinary halfback in Mitchell Pearce and a prop, who deserves his spot, on debut. Robbie Farah will only just be right to play. Selecting Uate will only weaken this team.

No doubt the pack was outstanding at home last start and the team had an absolute perfect preparation for Origin 1. This one will be far from perfect.

Maybe it will bring the group closer together. Maybe it's the mindset they will need to now take on that will help them them in the end.

Believe me, this will be one of the great victories for NSW if they can pull it off. If we lose, you blokes will obviously lay no blame on an interrupted preparation or change to playing personnel. Am I right?

Seriously why would you want him?

His a bad influence and always causing trouble.

Raiders are a young team don't need his crap.
