There is more to the case than just the alleged assault. He has still lied to the police (obstruction of justice) and his club, there is still enough for the cops to go on, even if she doesn't make a statement

Katie Milligan begs to see Greg Bird


KATIE Milligan, the injured girlfriend of disgraced rugby league star Greg Bird, has told how she intends to withdraw an Apprehended Violence Order put in place by police for her protection. The American law student was allegedly glassed by Bird in an argument between the two in their beachfront apartment in Cronulla in August.

Lawyers for Ms Milligan, 24, told the Downing Centre Local Court today they would lodge an application to revoke the AVO when Bird faces court next on October 9.

Milligan entered the court this morning for her first encounter with a court over the whole affair, since being released from hospital.

She appeared to have darkened her formerly blonde hair and the infamous scars caused by the incident were less vivid.

Bird, also 24, has pleaded not guilty to maliciously inflicting grievous bodily harm on Milligan, who underwent emergency surgery to her left eye after the attack.

She has been left with extensive scarring on her upper eyelid and cheek.

But outside court, Ms Milligan maintained she supported her boyfriend.

Wearing a black skirt and silky cream blouse with her eye scars disguised under make-up, Ms Milligan said she still "very much" stood by Bird.

"I definitely don't want the AVO," she said.

With her lawyer beside her, she declined to answer if she planned to move back in with Bird, but she did confirm they had spoken several times since the incident.

Bird's lawyer, Les Nicholls, said an application to vary his client's bail conditions would also be lodged on October 9.

While her case was in progress, Milligan did not enter the court room.

Instead, she sat typing on her laptop and texting on her mobile phone, occasionally glancing anxiously toward the court.

A court support person who was assisting Ms Milligan was heard to ask why the court was so crowded.

"Its pretty high profile, that's why," Ms Milligan replied.

Katie Milligan, the girlfriend of NRL player Greg Bird, failed today to get an apprehended violence order against him revoked at Downing Local Court.

Bird, who has been stood down indefinitely as the Cronulla Sharks five-eighth, was charged last month with one count of maliciously inflicting grievous bodily harm after Ms Milligan suffered cuts and a fractured eye socket when she was hit in the face with a glass.

The 24-year-old ended up in hospital after an incident at Bird's Cronulla apartment, in Sydney's south, on Sunday, August 24.

The AVO was taken out by the police on behalf of Milligan, but without her consent, her lawyer, Philip Sim, said.

But the court said today it did not have the jurisdiction to revoke the order and that Ms Milligan had not gone through the proper process.

The matter was held over to October 9.

Mr Sim said outside the court: "We just want to outline our position, which was that she doesn't want an AVO."

He said she had never consented to it in the first place.

Ms Milligan, who has been instructed by her lawyer not to comment, broke her silence to say she "definitely doesn't want an AVO".

She has said that she still loves Bird.

If Milligan had been the complainant she could. In this case its the NSW Police who have made the application & are the complainant in the matter. Its up to them to reverse the application.

That's what I'd like to know. I also don't understand how someone can have an AVO placed on their behalf in the first place without their consent. If the cops want to offer protection then fair enough, but there's no way they should be preventing her from seeing him if she wants to.

I feel sorry for this girl even more. Not only has she get serious facial wounds, had unwanted media attention, now she can't even get an AVO removed when she wants it to be. FFS the courts and the cops are so screwed up.

That could happen, but its a matter for the police to decide to not proceed rather than a simple reversal of process for the alleged victim.

Without knowing the particular circumstancs its hard to assess if there is scope for that to happen in this case.

Yes,how dare they protect someone who has allegedly been violently assaulted!

If she doesn't want the AVO out on him that should be her right, regardless of what the police think. She's been through hell enough, she shouldn't have to go through the courts system and then the NSW police just in an attempt to get it removed. She's probably been stressed out to a great extent by this, not to mention all the legal fees she'll be payingg to try and get this removed. Great way to treat the victim.

Legal eagles, what is the 'right jurisdiction', and what was the 'proper channel' this application should have been made to? Has her lawyer just fkd this up massively?

Eels Dude, part of the problem in a matter such as this, is that police officers on behalf of the crown are sworn to keep the peace and protect its citizens and the officer in question would have made sworn statement detailing certain facts in this matter.

As such it makes it a bit more complicated to backtrack as opposed to a citizen changing their mind (so to speak)
